I invested in a condominium in the United States—can I apply for an E-2 visa based on this investment?
In short, no. The E-2 visa is a way for people to invest in an active business enterprise and then come to the United States to manage these businesses. Since the investment is towards an active business, purchasing a home and generating passive income this way would not constitute you running a business.
The types of businesses that may qualify for an E-2 visa depend only on your imagination—so long as it is for-profit enterprise that you manage and that can generate sufficient revenues that support more than yourself and your family. If you are interested in real estate, instead of investing in a property you could start a business that manages vacation rental properties and use your investment funds for the start up costs of this business. While the E-2 visa is for investors, it is for those interested in developing and directing, in short, running, a business in the United States.
